日本在留中の外国人が現に与えられている「在留資格」に属する活動を終止して新たに別の「在留資格」に属する活動を行おうとする場合、身分関係の変更等の理由によって現在の「在留資格」とは異なる「在留資格」を得たいとする場合「在留資格の変更」の手続きをしなければなりません。
この申請を行う在留外国人が最寄りの地方出入局在留管理局に自分で出向いて行わなければなりません、申請人が16歳未満の場合や病気などの事由がある場合、その父母や配偶者等が本人に代わって申請できます。
法務大臣から申請取次機関の承認を受けている企業、学校等の職員又は申請取次の承認を受けている行政書士を通して申請を行う場合には申請人本人は地方出入局在留管理局へ出頭する必要がありません。
